There were more than 131,000 births in Georgia in 2015, the most recent year for which data are available, according to the Centers for Disease Control and Prevention (CDC). Here in Marietta, we are blessed to have the WellStar Kennestone Hospital with a world-class birthing center and a Level 3 neonatal intensive care unit for treating the most vulnerable of babies.
The day of your baby’s birth is supposed to be one of the most joyful days of your life. However, for some parents, the day becomes one of tragedy as they learn that the mother or their child has been injured during birth. The attorneys of Kaufman Law, P.C. understand the pain you are experiencing at this time, because we have witnessed it in parents many times. If your child suffered a birth injury, our experienced attorneys are here to help you get the compensation you and your child deserve.
Why Should I Make a Birth Injury Claim?
Patients have a right to expect their doctors will act with a reasonable care when delivering their babies. What is reasonable for a doctor in this case is a higher standard than what is reasonable for the average person, because of their specialized training. A doctor is considered negligent if he or she acts or fails to act to safeguard your health in a way that another reasonable doctor would have.
Not every injury suffered at birth is due to the carelessness of a doctor. But when a doctor or other healthcare provider fails to bring you and your baby safely through the delivery through negligence, you have the right to be compensated for the injury suffered as a result.
Injuries to the Mother
Injuries to the mother may result from a number of causes. A doctor may fail to note the presence of a dangerous condition known as preeclampsia, in which a mother experiences high blood pressure, which may lead to seizures during the delivery. In other cases, a doctor may fail to recognize that delivery is not progressing, and fail to perform a cesarean-section delivery, resulting in harm to the mother. In any case, where a doctor fails to recognize harm may come to the mother and take the proper action, a birth injury may result.
Injuries to the Baby
The most common injuries to the baby during delivery have to do with a lack of oxygen to the brain, causing paralysis or brain damage. Cerebral palsy is the most common birth injury babies suffer and there is no cure for the damage once it is done. Victims of cerebral palsy may require special medical care for their entire lives and may have difficulty with speech and learning.
Other injuries may include injuries to the shoulder if it is stretched too much during delivery, or damage to fragile internal organs. Birth injuries often involve expensive medical treatment and rehabilitation to recover.
If you or your baby was injured in delivery, contact Kaufman Law, P.C. immediately – you have a limited amount of time in which to file a claim. You have a right to compensation for the harm that was done, and for the medical expenses incurred as a result of the birth injury
